Competition law is not reserved for multinationals. A simple poorly calibrated pricing policy or too rigid territorial exclusivity can lead to heavy sanctions (up to 10% of turnover).
My preventive and curative approach:
- The Audit of Practices: I analyze your price schedules, discounts and distribution contracts to detect the risks of abuse of economic dependence or agreements.
- Anticompetitive practices: Analysis of the risks of cartel, abuse of a dominant position or abuse of economic dependence.
- Concentration control: Analysis of the feasibility of mergers and acquisitions in terms of notification thresholds (France/EU).
- Competition inquiries: Assistance during inspections by the Competition Authority or the DGCCRF (visits and seizures) or requests for information from the administration: I am at your side to supervise the procedure and protect your rights.
- Merger Control: If you buy a competitor, I check whether the transaction must be notified to the Competition Authority to avoid “Gun Jumping” (absence of mandatory notification to the authorities).
- Compliance: Implementation of compliance programs to train your sales teams in best practices (“Do's and Don'ts”).
